41 Mr Muhamad Faisal Bin Abdul Manap asked the Minister for Social and Family Development and Minister-in-charge of Muslim Affairs (a) from 2011 to 2020, how many cases of Muslim divorce are classified under (i) talak rajie (ii) talak bain (iii) taklik (iv) fasakh and (v) khuluk; (b) how many of these divorce cases have been pronounced by hakam; and (c) how many cases are presented to the second set of hakam.

Mr Masagos Zulkifli B M M: Between 2011 and 2020, there were a total of 16,456 Muslim divorces registered with the Syariah Court (SYC). During the same 10-year period, a total of 915 cases involved the appointment of an arbitrator (hakam) in the divorce proceedings. Less than one percent of such cases required a second set of arbitrators.

The SYC does not track divorce data by the classifications cited. We consider every divorce case on its own grounds and merit and the legal process is the same.
